I. Introduction
When you choose Starknight, you are trusting your personal information to Starknight. We promise to maintain your trust in us. First, let us help you understand our privacy policy.

This statement explains what personal information (hereinafter referred to as "Information") we collect, how we use and share this Information, and what choices you can take regarding this Information. It is recommended that you read this article in conjunction with our Privacy Overview, which focuses on the description of this Privacy Policy and outlines the Information we collect and how we use it.

II. Overview
A. Scope
This statement applies to users of Starknight, website and other services worldwide.

This statement will explain how Starknight and its affiliates collect and use information. This statement applies to all Starknight users worldwide.

A customer who has booked or received Guardian Services and related services through a Starknight Account.

Professional Guardian/Guardian: A professional guardian who provides guardian services to customers through Starknight accounts or partner companies.

This statement also governs Starknight's collection of other information related to Starknight's services. For example, we may collect information about Starknight's or Starfort App platform owners or employees, contact information about individuals who manage and use corporate customer accounts, or information about individuals who have started but not completed online activation of a professional Guardian or partner.
 
In this statement, all parties subject to this statement are referred to as "users".

Our privacy practices are subject to the laws that apply to the countries where we operate. This means that we only carry out the data processing activities described in this statement locally when the laws of a particular country or region permit.


III. Information Collection and Use

A. Information We Collect
Starknight collects the following information:

Provided by users to Starknight during the use of our services
Starknight has collected the following information from the following sources:

1. Information provided by users. This includes:

Account Information: We collect information when a user creates or updates a Starknight account or places an order through the guest checkout feature. This includes name, email address, phone number, login name and password, address, profile photo, payment or banking information (including relevant payment verification information), user settings (including accessibility settings), and Starknight Help partner loyalty program information.

For Guardians and Partners, this also includes their insurance information, emergency contact information, and health or eligibility certification required to use the Starknight APP to provide services.
Background Check Information (Professional Guardians and Partners): This includes information submitted during the Professional Guardian/Partner online onboarding process, such as mission history or criminal record (where permitted by law), good conduct status, known aliases, previous addresses, and work rights. Starknight Service Providers may collect this information.
Identity verification documents and photos: This includes government-issued IDs such as a driver’s license or passport (which must include an ID photo and number, date of birth, and gender), good conduct certificates, and user-submitted photos such as selfies and profile photos.
Use of demographic information: We collect demographic information such as date of birth/age, gender, or occupation when necessary to enable certain features or provide access to age-restricted products or services. For example, we collect a user's date of birth or age when verifying eligibility for Starknight Points. We also collect or infer (using first names) gender information to allow female or non-binary users to specify preferences for providing or receiving services, marketing, and advertising to female or non-binary users.

We also collect demographic information, such as age group and household composition, through user surveys.
We collect information (including chat logs and call recordings) when users contact Starknight customer support, provide ratings or feedback for users or Guardians, use features that allow users to upload content or send recordings (including in-app recordings or dashcam recordings), or otherwise contact Starknight.


Trip Information: We collect itinerary information provided by users of the Starknight, Starfort app, including the time and date of an upcoming Guardian reservation. We collect this information when users manually enter itinerary information into the Starknight Starfort app itinerary form.

2. Information created during the use of our services. This includes:

Location Data (Professional Guardians and Partners): We collect precise and approximate location data from professional guardians and partners mobile devices when the Starknight App is running in the foreground (the App is open and displayed on the screen) or background (the App is open but not displayed on the screen).
Location Information (Customers and Guardians). We collect precise and/or approximate location information from customers and guardians mobile devices if they have set their settings to allow access to information via their devices.

Starknight collects this information from the time a user calls a ride or places an order until the ride ends. In addition, Starknight continues to collect this information while it is in the foreground (the App is open and displayed on the screen) . To learn how customers and guardians can enable the collection of precise location data, please see "Choice and Transparency" below.

Even if you do not allow the collection of location data from your mobile device, customers and guardians may still be able to use the Starknight App . However, this may affect certain features of the Starknight App . For example, if a customer or guardian does not enable accurate location data, they will have to manually enter the customer's pick-up address, which may cause the App to be inaccurate or not function properly.

In addition, even if a customer has not enabled the collection of precise location data from their device, precise location data collected from a Career Guardian device during a trip will be linked to the customer's account. This data will be used for customer support, fraud detection, insurance, litigation and invoice generation purposes.
Transaction Information: We collect transaction information related to the use of our services, including the type of service requested or provided, itinerary or order details (such as date and time, requested pickup location, and trip distance), and payment transaction information (such as the name and location of the partner, the amount charged, and the payment method). We also link the user's name to the person who uses the coupon code.

Usage Information: We collect information about how users interact with the Services. This includes date and time of access, app features or pages viewed, browser type, and app crashes and other system activity.
Device Information: We collect information about the device you use to access the Services, including hardware model, device IP address or unique device identifier, operating system and version, software, preferred language, advertising identifier, device action information, and mobile network information.
Communication Information: We collect information about user-to-user communications initiated by users through the Starknight App. This includes the type of communication (phone call, SMS or in-app message), date/time and content (including call recording only if the user has been notified of the call recording in advance).

3. Information from other sources. These include:

Users who participate in our referral program. For example, if a user refers another person, we will receive information about the referral from that user.
Users or others who provide information about a claim or objection.
Starknight business partners through which users create or access their Starknight accounts, such as payment providers, social media services, or apps or websites that use the Starknight API or provide the API to Starknight for use.
Starknight 's business partners in connection with debit or credit cards issued by Starknight 's partner financial institutions are limited to those business partners disclosed in the card's terms and conditions.
Service providers help us verify user identities, background information and employment qualifications, detect fraud, and screen users based on sanctions, anti-money laundering or know your customer requirements.
Insurance or financial service providers for professional guardians and/or partners.
Cooperate with diversified security companies or bodyguard companies (professional guards or partners will use our services through the associated accounts of such companies).
Available public sources.
Marketing partners and service providers, including banks in connection with cashback programmes, and data resellers.
Law enforcement officials, health authorities and other government agencies.

B. How we use information
Starknight collects and uses information to provide reliable and convenient transportation, delivery, and other products and services. We also use the following information:

Research and Development
Enable communication between users
Marketing and Advertising
Send notification and OTP to user

Starknight uses the information we collect to:

1. To provide our services. Starknight uses information to provide, personalize, maintain and improve the services.

This includes using the information to:

Create/Update Account.
Enable daemons and other services/features, such as:
Use location data to provide customer pickups and task directions, calculate estimated arrival times, and track customer pickup progress.
Enable features that involve data sharing, such as sharing the name and information of a Professional Guardian with customers for pick-up, or using the ETA sharing and fare splitting features.
The calling user is matched with available professional Guardians and Partners based on personal data (such as location and proximity to other users), user settings/preferences (such as preferred pickup locations), and non-personal data (such as the type of Guardian requested).


Calculating prices and trip costs includes using location information and trip or order details (such as the pick-up and drop-off address of the caller). We may also consider non-personal information or factors, including date and time, estimated distance and time, minimum base trip fare, taxes and fees, and automatic mark-up fees.
Process payments and enable payment and electronic credit products such as Starknight Point.
To create a personalized account for a user. For example, we may provide personalized recommendations based on a customer's previous orders and pickup locations.
Provide receipt issuance solution.
To provide users with itinerary or ride updates, generate electronic details, and notify users of changes to our terms, services, or policies.
Perform tasks necessary to maintain our services, including troubleshooting software errors and operational issues.
Starknight performs the above activities to fulfill the terms of the agreement signed with the user, or to meet such purposes, or for the legitimate interests of Starknight and the user.

2. Security, Fraud Prevention and Safety. We use information to help maintain the safety, security and integrity of Starknight Services and users. This includes:

Verify a user's account, identity, or compliance with security requirements.

For example, we may conduct background checks (including criminal records where required or permitted by law) on professional escorts and partners to verify their identities and qualifications to provide transportation escort or transportation services.

In Taiwan, we may use name, date of birth, email address, phone number, payment information, and third-party payment systems to verify the identity of customers and guardians to help prevent fraudulent accounts from using our services.

We process and compare user profile photos, government-issued ID photos and numbers, or other user-sent photos to perform this verification, including through the use of facial recognition technology in some areas. We also use such technology to prevent ID photo theft or to prevent users from creating multiple accounts.

We also use facial recognition technology to prevent Starknight accounts from being hijacked by someone other than the account owner. This is done through Starknight's real-time identity check, which regularly requires professional Guardians and partners to take a selfie before going online and compares it to the basic profile photo.
We also use this feature to verify changes to your bank account information and to help you regain access to your account.

Use customer service information (including security incident reports), device data, transaction and usage data to identify potentially unsafe Guardian behavior. This may result in Guardians and Partners receiving messages encouraging safe journeys and/or deactivating accounts after manual review.
Use account, device, location, usage, transaction, and other information (including communications between users and metadata) to prevent, detect, and combat fraud (including guest user fraud).
Use reported incidents, user ratings*, and other feedback to encourage users to use the Starknight platform safely and abide by our Terms, and not to deactivate low-rated users.
Uses Career Guardian data (e.g., past trip information and incident reporting rates) and Customer data (e.g., account information, cancellation and incident reporting rates, current pickup location, past trip information, and ratings information) to predict and help avoid pairing users that could result in an increased risk of conflict. * We also try to avoid pairings where, for example, one user has previously rated another user 1 star.
Use location, phone number, username, details, and other relevant information to provide real-time support from safety experts during your trip or pickup.
The fraud and unsafeguarding prevention and detection activities described above may be considered personal data under applicable law and may result in the deactivation of a user (usually only after manual review). For information on how to object to the above activities, please see "Choice & Transparency" below.

Starknight performs the above activities in order to fulfill the terms of the agreement entered into with the user and/or for the legitimate safety interests of Starknight, the user and the general public.


Service Support. Starknight will use the collected information (which may include call recordings, chat records, in-App recordings, and videos recorded by the Guardian's secret recorder (if any)) to provide customer service support, including investigating and handling user concerns, and controlling and improving customer service support responses and processes.

Starknight performs the above activities to fulfill the terms of the agreement signed with the user, or for Starknight's legitimate interests in monitoring and improving customer support.

4. Research and development. We use data for analysis, machine learning, product development, research, and testing. This helps us provide more convenient and user-friendly services, enhance the security of our services, and develop new services and features.

Starknight performs the above activities based on Starknight ’s legitimate interests to improve and develop new services and features.

5. Enable communication between users. For example, a professional guardian may send a message or call the customer to confirm the pick-up location, a customer may call a professional guardian to retrieve lost property, or a partner may contact the customer to confirm order-related information.

Starknight performs the above activities to fulfill the terms of the agreement signed with the user.

6. Marketing and Advertising. Starknight uses information (except visitor user information) to market the services of Starknight and its partners.
How do end users consent to receive messages
We ensure we Starknight Ltd will not share end-user information with third parties/affiliates for marketing/promotional purposes. We may share end-user opt-in data with our subcontractors or outsourced service providers solely to fulfill the service we render to our end-user.
We specifically use account, approximate location, device and usage data, preferred language, and travel and order history to deliver personalized advertising and marketing communications based on a user’s observed or inferred location, interests, and characteristics (which may include inferred gender*).

This includes using the data for the following purposes:

Send emails, text messages, push notifications, in-app messages or other communication methods to market or promote Starknight products, services, features, offers, rewards, sweepstakes, news and events. For example, we may send push notifications to recommend users' frequent destinations, or provide offers or rewards for similar products or merchants through in-app messages based on products or merchants that users have ordered in the past.
Display personalized ads in the Starknight App or display third-party advertisements related to our services. For example, displaying companies or organizations that provide services through the Starknight App. These advertisements (called "sponsored ads" in the Starknight App) might include personalized recommendations based on the user's location and order history.
We also display advertisements for third-party products that are not provided by the Starknight App. These advertisements may contain links to third-party apps or websites. When users visit such apps or websites, they should refer to the privacy statements of such third parties for information about the collection and use of data.

This also includes providing personalized advertising based on information about the user's current itinerary or security/protection request (including the time of the request and the service requested).

We also measure the effectiveness of Starknight advertisements, third-party advertisements displayed in the Starknight App, and third-party advertisements related to our Services.

Starknight performs the above activities based on Starknight's legitimate interest in informing users about services and features provided by Starknight or Starknight's partners. Please refer to the "Choice and Transparency" section to learn about the options available to users when Starknight uses their information for marketing and advertising purposes.

7. Non-marketing notifications. Starknight may use data to send surveys and other notifications that are not for marketing of Starknight or its partners' services or products. We may also send users information about elections, voting, referendums, and other political processes on our services.

Starknight performs the above activities to fulfill the terms of the agreement signed with the user, or for the legitimate interests of Starknight and its users to notify users of relevant events that may affect the use of Starknight services.

8. Legal Process and Requests. We may use information to investigate or resolve claims or disputes related to the use of Starknight Services, to comply with applicable laws, regulations, operating licenses, insurance policies or agreements, or to use such information in response to legal process or government requests (including law enforcement agencies).

Starknight performs the above activities based on Starknight 's legitimate interests, to investigate and respond to claims and disputes regarding the use of Starknight 's services and features, and / or to comply with applicable legal requirements.

C. Cookies and Third-Party Technologies
Starknight and its partners use cookies and other identification technologies in our apps, websites, emails and online advertisements for the purposes described in this statement and the Starknight Cookie Statement.

Cookies are small text files stored on your browser or device by websites, apps, online media and advertisements. Starknight uses cookies and similar technologies for the following purposes:

Verify user
Remember user preferences and settings
Determine the popularity of your content
Run advertising campaigns and measure their effectiveness
Analyze website traffic and trends and gain a general understanding of the online behavior and interests of users of Starknight Services.
We may also allow others to provide us with audience measurement and analytics services, to serve ads on our behalf across the internet, or to serve ads for other companies’ products and services on our apps, and to track and report on the effectiveness of those ads. These entities may use cookies, web metrics, SDKs, and other technologies to identify the devices that visitors use to visit our websites, as well as when those users visit other online sites and services.


D. Information Sharing and Disclosure
Starknight's services and features require us to share information with other users, either at the request of the user or with the consent of the user or other users. We may also share such information with affiliates, subsidiaries and partners for legal reasons or in connection with claims or disputes.

Starknight may share information in the following circumstances:

1. Share with other users

These include:

Share customer names, ratings, and pickup locations with Career Guardians.
We may share information about Professional Guardians and Partners with customers, including name and photo, guardian level and photo, location (before and during the trip), average rating provided by users, total number of trips, length of time the user has registered as a Professional Guardian or Partner, contact information, and basic information about the Professional Guardian or Partner, including positive reviews and other feedback submitted by past users.

We will also provide customers with electronic details that include details of the charges, the name of the professional guardian or partner, a photo and a route map. We may also provide other information in these electronic details as required by law .

Additionally, if a user creates an account using an email address that is affiliated with a Starknight Enterprise account owner (i.e., employer), we may use and share the account information (e.g., name and email address) with that account owner to help the user pay for trips or orders for that Starknight Enterprise account.
For users who participate in the Starknight referral program, we will share the specific information of the referred user, such as the number of trips, with the users of the referral program based on demand to determine the referral reward.

2. At the request of the user or with the user’s consent

This includes sharing information with:

Sharing with other people upon user request. For example, we may share a user's estimated arrival time and location with friends and family upon user request, or share a user's itinerary information with friends and family when the user is splitting the trip costs.
Starknight business partners. For example, if a user books a service through a partnership or a discount plan provided by a third party, Starknight may share certain information with the third party. This may include other services, platforms, apps or websites integrated with our API; system providers or services; objects with APIs or services integrated with us; or partners, merchants or other Starknight business partners and their users related to discounts/rewards, competitions or special services.
Emergency Assistance Services. We provide features that allow users to share information with police services during emergencies or after certain incidents. For more information, see Choice and Transparency and Emergency Information Sharing below.
Insurance companies. If a user has reported or filed a claim with an insurance company in connection with the Starknight, Starknight will share certain information with the insurance company in order to adjust or process the user's insurance claim.
Questions or comments posted by users through publicly accessible platforms (e.g. publicly accessible Starknight blogs and Starknight social media pages), including any information contained in questions or comments posted by users.

3. Sharing with Starknight parent and subsidiaries and affiliates

We share information with our parent and affiliated companies so that they can assist in providing services or process the information on our behalf.

4. Sharing with Starknight Service Providers and Business Partners

These include the third parties or categories of third parties listed below. If a third party is identified, please refer to its linked privacy statement for information about its collection and use of personal data.

-Payment processors and facilitators, such as PayPal.
-Provider of background checks, identity verification and risk solutions.
-Cloud storage providers.
-Customer support platforms and service providers.
-Google, relating to the use of Google Maps in the Starknight.
-Service providers who assist Starknight in enhancing the security of the Starknight App and Services.
-Service providers who provide our artificial intelligence and machine learning tools and services.
-Consultants, lawyers, accountants and other professional service providers.
-Insurance and lending partners.
-Starknight filed or reported by users, and to adjust or process insurance claims.

5. Sharing based on legal factors or disputes

Starknight may share user information when Starknight believes that applicable laws, regulations, business licenses, agreements, policies, legal procedures or government requirements, or when such information should be disclosed for security or similar reasons.

This includes sharing data with law enforcement, public health agencies, other government agencies, airports (if airport agencies require data sharing in order to operate within the airport), insurance companies, or other third parties to enforce our Terms of Service, User Agreement or other policies, protect the rights or property of Starknight, or the rights, safety or property of others, and assist in handling claims or disputes related to the use of the service. If you use someone else's credit card and a dispute arises, we may share user information (including itinerary or order information) with the credit card holder in accordance with legal requirements.

The information may also be shared with other persons in connection with any merger, sale of company assets, consolidation, reorganization, financing, acquisition of all or part of our business by another company, or during negotiations of any of the foregoing.

6. Sharing with consent

Starknight may share users' information in ways not described in this statement after notifying the user and obtaining their consent.
 
E. Data Retention and Deletion
Starknight will continue to retain the information for the above purposes until it is no longer needed. Users can request to delete their account through the Starknight App and website.

Starknight will retain user information for the period of time necessary for the purposes listed above. The actual period depends on the type of information, the category of users to which the information relates, the purpose for which we collected the information, and whether an account deletion request is required for the purposes described below.

For example, we may adopt the following data retention practices:

If the information is necessary to provide the service, we will retain such information for as long as the user has an account. For example, account information.
If the information is required to comply with tax requirements, it will be retained for the specified years in each country. For example: itinerary or delivery location information of professional escorts and delivery partners.
For the purpose of maintaining security or preventing fraud, we may retain the data for a specified period of time as necessary. For example, we may retain the data of unfinished online registrations for 1 year or longer, and the data of rejected online registrations for 7 years or longer.
Users can request to delete their account through the Settings > Privacy menu in the Starknight app , or through the Starknight website: here for Customers and Guardians; here for Professional Guardians and Partners.

After receiving an account deletion request, we may retain some of its information as necessary for safety, security , fraud prevention or regulatory compliance purposes, or for user account-related issues (such as outstanding credits, or unresolved claims or disputes) to cope with actual or potential tax, litigation or insurance claims.

Starknight provides users with the ability to access and/or control the information Starknight collects, including through the following methods:

Starknight also provides users with the ability to request access or a copy of their personal information, make changes or updates to their account, request account deletion, or request restrictions on Starknight's processing of user information.

1. Privacy Settings

Preferences for customer and guardian location data collection and sharing, emergency data sharing, and notifications.

Collect location data (customers and guardians)

Patrons and Guardians can enable/disable Starknight's collection of their mobile device's location data through their device settings, which can be changed through the device's "Location Sharing" menu.

Share real-time location (customers and guardians)

Customers and Order Takers can enable/disable Starknight's sharing of their mobile device's real-time location data with Career Guardians or Partners (as applicable) through their device settings. These settings can be changed through the device's "Location Sharing" menu.

Emergency Information Sharing

Customers may allow Starknight to share real-time location data on their mobile devices with police, fire and ambulance services in emergency situations. This data includes approximate location at the time of the emergency call, Guardian information; Customer name and phone number; pick-up location, etc.

Notifications: Offers and news

By signing up to use either the Starknight or Starfort App, users agree to receive push notifications from Starknight LTD, who will share special offers and updates via push notifications.

Third-party app access permissions

Users may authorize third-party apps to access their Starknight account information to enable additional features.

2. Device permissions

Most mobile device platforms (iOS, Android, etc.) have defined certain types of device data as data that apps cannot access without the device owner's permission, and these platforms also provide different methods to obtain data access permissions. Users should check the available settings on their device or confirm with the vendor.

3. Rating page in the app

After each trip, Careers and Customers can rate each other from 1 to 5. The average of these ratings is linked to the user account, and other users who provide or receive services will be able to view the rating information. For example, Careers can view Customers' ratings, and Customers can also view Careers' ratings.

Customers can view their average rating in the Starknight app's main menu.

Career Guardians can check their average ratings in the Career Driver App. For more information.

Partners may also receive ratings from customers.

 
4. User Information Request

Starknight provides users with various ways to understand, control and raise questions and comments about the way Starknight processes personal data. In addition to the methods described below, users may also submit data requests through our questionnaires: here are customers, guardians and partners.


Changing or Updating Information: Users may contact Starknight to edit their name, phone number, email address, payment method, and basic profile photo.
Deleting data: Users can request to delete their account through the Starknight settings.
Objections, Restrictions and Complaints: You may ask us to stop using all or part of your data, or to restrict our use of your data. This includes objecting to our use of your data based on our legitimate interests. However, Starknight may continue to process your data after you have raised such an objection if the use is legal or permitted by law.
 
Additionally, depending on your location, you may have the right to lodge a complaint with the data protection authority in your country about how Starknight processes your data. For example, users in the European Union and Latin America may lodge such a request with the data protection authority in their country of residence.

Respond to requests for information from government or law enforcement agencies as necessary.
Starknight is committed to protecting your personal data regardless of where you are located, where it is processed or by whom. This includes implementing global measures to protect your data, including:

Protect user data in transit (including through encryption) and at rest.
Mandate company-wide training on privacy and data security.
Implement internal policies and procedures to limit access to and use of user information.
Government and law enforcement access to user data is restricted unless required by law, there is an imminent threat to security, or the user has consented to access.

Onward Transfer: Starknight is responsible for transferring personal information to third parties, subject to Starknight’s authorization. Please see "Information Sharing and Disclosure" above for information on the parties to whom Starknight may transfer personal information.
Data Requests from Law Enforcement: Starknight may be required under applicable law to share user information in response to legal process or governmental request, including requests from law enforcement agencies, including user information that requires Starknight to authenticate.
Investigation and Enforcement: Starknight are subject to the investigative and enforcement powers of Taiwan's relevant authorities.
Questions and Disputes: Customers and Partners may refer complaints to their local data protection authority and Starknight will try their best to work with that authority to resolve the complaint.


VI. Updates to this Privacy Statement
We may update this statement from time to time.

We may update this statement from time to time. If there are significant changes to this statement, we will notify users in advance through the Starknight App or other means, such as email. It is recommended that users review this statement regularly to learn about the latest information on privacy-related processing methods.

By using our services after the statement is updated, you agree to the updated statement to the extent permitted by law.
